HUPP RECALL PETITION DENIED 11/12/10

Jay Hupp, John Dobson & Attorney Myers in Mason County Superior Court

What Language Am I Speaking?

Jay Hupp and I disagree on what his job as Port Commissioner is.

Jay argues that what he is doing IS his job.

Jay believes that someone in Olympia will decide whether the ADAGE project goes forward, and that the science and the medicine pointing out the damage ADAGE could wreak on our community doesn't have anything to do with his job.

Jay's job, according to Jay, is to bring businesses to the Port, heavy industrial businesses apparently, but businesses, and to get leases signed. In Jay's mind he has been, and still is doing his job.

Jay looked a little miffed today. He did not like the citizens calling him to task. You could see it in his face; even his ears were red.

He's mad because in his mind he is doing his job, which is business, and we are giving him hell for it.

As the citizens' recall petition pointed out, and something Jay may want to read a couple of times:

"The people of this state do not yield their sovereignty to the agencies that serve them. The people, in delegating authority, do not give their public servants the right to decide what is good for the people to know and what is not good for them to know. The people insist on remaining informed so that they may maintain control over the instruments that they have created." (RCW 42.56.030)

I don't care what Her Honor Judge Pomeroy said, the citizens deserve a lot better from the Port than they are getting with Jay Hupp at the helm. Minutes for a four agency inter-governmental meeting that say something like "items of mutual interest," is not a satisfactory report to the citizens.

Did the PUD keep minutes of this meeting? If not, why not?

Did the City keep minutes of this meeting? If not, why not?
Did the County keep minutes of this meeting? If not, why not?

At a time when each of these agencies is under close scrutiny by the public for operating any way they like, is it prudent for the leadership of these four governmental agencies to meet and provide the citizens of the city, county, port and PUD with: "Items of mutual interest?"

I don't think that Jay Hupp and friends should be too smug about their perceived victory in court today.

If the following is the law of the State of Washington, the citizens who signed the recall petition may not have received justice today.

Mason County Superior Court Judge's Bench

"The people of this state do not yield their sovereignty to the agencies that serve them. The people, in delegating authority, do not give their public servants the right to decide what is good for the people to know and what is not good for them to know. The people insist on remaining informed so that they may maintain control over the instruments that they have created." (RCW 42.56.030)

  2. Jay really did not like having you take his picture there. His wife went out of her way to try to intimidate another photographer outside of the court room. Does Jay realize that he distributed copyrighted material to dozens of people as part of his irrelevant rebuttal? Jay might want to back off, unless he wants to be sued for copyright infringement.

  3. Jay Hupp ALL WAYS scowls at me when I take his photo. I have quite a collection of "Jay Scowling at Me" photos!

However, it might be good for Jay to remember that this IS the USA! He & his wife Dianna, have NO JURISDICTION over WHERE or WHEN photos are taken or NOt taken in public situations.

To make sure about taking photos in a COURTROOM situation, I asked the Court Clerk if it was okay. She said YES, if the JUDGE was NOt present.

If someone doesn't want their photo taken in a public place in this country, there is always the option of putting your hand up over your face.

However, it probably would NOt behoove public officials to do so...they voluntarily stepped into the limelight.

  4. Teehee, I would love to see your collection of scowling Jay photos.

Maybe we can auction them to raise funds for Commissioner Jack Miles re-election campaign.

As the sole port commissioner who remembers who his employers are, we need to be sure Jack is reelected.

Besides, if we make them poster size, Christmas gifts...huh? Dart boards? Huh?

  5. It would be a lot of fun, Christine, if you posted a Blog Spot dedicated to your Scowling At Me (Us) photos! That way others can see clearly how we folks who attend the Port meetings are treated: If looks could kill, we'd all be wounded or dead!

  6. And of all people to scowl at, Christine, you are the least offensive of us crazy unrealistic air-breathers, who erroneously believe Jay works for us! You are not openly contemptuous and hostile to Hupp, ShelTon, Erickson, et al., like I am.

I have earned and deserve their scowls. I look at them the same way I would look at something awful and smelly that is stuck to my shoe. That's disrespect.
