SIMPSON/SOLOMON MDNS REVISED

Good Afternoon.

You are receiving this e-mail because you have either expressed an interest in the Simpson (Solomon) Biomass Facility proposed on the Oakland Bay waterfront in Shelton Washington and/or you have submitted comments on the proposal and/or you have added your name to our notification list.

On March 24, 2011, the City of Shelton issued a Mitigated Determination of Nonsignificance (MDNS) relative to the proposed Simpson (Solomon) Biomass Cogeneration Facility.

At their regular City Commission meeting held last evening, April 4, 2011, the mayor of the City of Shelton made a public statement indicating that the City has received a number of inquiries regarding the timing and process for filing an appeal of the determination, as the specific codes cited in the MDNS document itself and the notice published by the City appear to be inconsistent.

To clear up the inconsistency City staff has withdrawn the Notice of Determination issued by the City of Shelton on March 24, 2011 and issued a revised determination (attached below) that identifies the appropriate appeal mechanism (in this case in conjunction with any future permit decisions in compliance with RCW 43.21C.075). The City has further amended mitigation measure number 4 to require a determination to be made on pending air quality permits and reviews from State and Federal air permitting authorities prior to the City initiation of any public hearings or decisions on local land use permits. This will allow the City to participate in the State and Federal air permit review process before considering any local land use permits.

I have also attached (below) a copy of the official notice of this action to be published in the Shelton Journal.
