Letter of Censure to Be Presented at 7/5/11 Port Meeting

I received this draft letter of censure from Commissioners Hupp and Wallitner that will be presented to me at Tuesday's Port meeting on 7/5/11.

Re: Letter of Censure

Dear Commissioner Miles:

The Board of Commissioners hereby submit to you this letter of Censure for your actions taken following the June 21, 2011 Port of Shelton Commission meeting and the Executive Session held during that meeting. By publishing comments in several local internet sites, (i.e. blogs), you have deliberatelly and intentionally disclosed confidential information gained through executive session discussions of the Board of Commissioners. Additionally, your comments were erroneous concerning comments by others during the meeting and thus misleading to the public.

By those actions, you have violated your oath of office through deliberate disregard of RCW 42.23.070 (4) which prohibits disclosure of confidential information gained by reasons of an officer's position. Any further violations of this statute and the Board will consider penalties provided for under RCW 42.23.050 for violationsof this chapter.

Consequently, the Port of Shelton Commission insists that you, as a member, preclude and ensure that there are no further violations of the above statute and any such disclosures in the future.

The Port of Shelton Commission further insists that you not convey impressions, through any methods of communications that would indicate that you represent the position of this commission on any issue unless authorized to do so beforehand by the commission as a body.

It has become abundantly clear that the Port is attempting to distract from its failure to bring jobs to Mason County by embarking on a campaign of retaliation against all those who would question its effectiveness. For those who have followed the devolution of Port management from the marginalizing of critics to the firing of an employee whistle-blower, the upcoming censure of a fellow commissioner/critic should come as no surprise. What the Port is really fighting against is transparency; management doesn’t want the public to see the culture of preferential treatment it extends to personal friends and relatives. But with each questionable event, those charged with managing Port business take us all further down a path that can only end in a legal quagmire. Such is the leadership provided by old age and arrogance.

  2. Tom, you have such a way with words: "The culture of preferential treatment it extends to personal friends and relatives." Nicely turned phrase.

    I hope that both Teresa and Commissioner Miles have really good lawyers, because with each passing day it is becoming abundantly clear that the Port of Shelton does not and that they really should stop taking advice from said attorneys.

    Inquiring minds should stay tuned because we are about to get a look at twelve months of billings from lawyers to the Port of Shelton.

    It should be completely obvious what is really happening with specific persons within the Port of Shelton. Let's review the events leading up to the current, destructive nature of this Port of Shelton -- whose Commissioners and Executive Director are supposedly serving the constituents of Mason County Port District 216.

    1)Hidden plans to bring in ADAGE became known and the public responds Negatively...The Port says that "nothing will be done if it is not a 'Good Fit' for the community --- We are Neutral --- We will listen to the people, however, They Did Not.
    2)The Port Refused to listen or read the 3,000+ Signature Petition requesting that they listen to the people's concerns.
    3)Mr. Hupp just avoided being Recalled. Obviously, people didn't think he was doing a good job --- in fact, they thought..........
    4)Due to numerous complaints on Procedural aspects and Misrepresentation of the Port, a Special Audit by the Washington State Auditor's Office was conducted towards the end of 2010.
    5)Questionable ethics and issues of possible conflict of interest surrounded the business dealings of the Port of Shelton, the Chairman of the Commissioners, with TruFab LLC and the involved equipment transactions.
    6)Questionable ethics and issues of possible conflict of interest surrounding the initial business dealings offered by Exec. Director Dobson to the Northwest Event Organizers, LLC.
    This issue is still under investigation and review. How much money has the Port of Shelton spent of Public Funds in protecting their "Image"?
    7)There have been numerous attacks against a Commissioner who had the Personal Strength to support his constituents. Why censur a Commissioner who only informs the public After such issues are part of the Public Record?

    Will this Destruction and Wedge-Building behavior continue at the Port of Shelton and only be resolved once the Self-Serving officials can be Voted Out?!!!

  4. Ah, and there's the rub- vote the bums out! But we may have to wait till next year. Between now and then we will continue to encourage the Port, through support, ridicule or legal action - whatever it takes - to a new resolve; one that serves the community at large,and not just their friends.

  5. Nice summary Dick; a laundry list of port dirty laundry!

    And Tom, how silly of the port not to recognize that you, and the rest of the pesky citizens, are serious about encouraging "through support." It does not have to be adversarial, or through expensive public disclosure requests, or legal actions, or ridicule. It does not have to be. It should not have to be.

    But with Executive Director Dobson, and his two yes-men, Hupp and Wallitner, support of the citizens is perceived as spying, or as interfering.

    These folks are not operating the port for the citizens they represent. Because of this, the last thing they want is "support" from pesky citizens - which could result in someone observing that which they prefer to keep hidden.

    That is the real problem with the crew running the port now, they don't operate in the light of day for a very good reason. Hupp loves the expression "under the radar" for a very good reason. Citizens continue to shine light into their shadowy activities, radar in affect, and they really don't like that.

    Maybe the port commissioners should visit a City of Shelton Commission meeting; and take notes.

    That "mutual respect" thing you see happening at a City of Shelton meeting is amazing.
